Terms of Service
These Terms of Service ("Terms") govern your use of the Shopify apps and website provided by AmareTech ("we", "us", or "our"). By accepting a pilot invitation, installing an app, or using our services (the "Services"), you agree to these Terms. If you do not agree, do not use the Services.
1. Pilot Services
AmareTech is piloting Product Registration & Warranty Claims, a Shopify app that lets participating merchants publish registration and claim forms, maintain registration records, review evidence, manage claim states, communicate about claims, and support RMA workflows. The pilot is a limited, pre-release evaluation. Features may be incomplete, changed, restricted, suspended, or removed, and participation does not guarantee a public release or any release date.
2. Accounts & eligibility
You must be invited or accepted into the pilot, have an active Shopify store, and have authority to install and evaluate apps for that store. Pilot access is personal to the participating merchant and may not be transferred or offered to another business without our approval. You are responsible for activity under your account and for maintaining the security of your Shopify access.
3. Pilot duration, pricing & support
- The pilot begins when access is granted and continues until either party ends participation or we transition the app to another release stage.
- Any pilot fee, credit, usage limit, or trial arrangement will be stated in the pilot invitation, in the app, or in a separate written agreement. We will not charge an unstated fee.
- Pilot support is provided on a reasonable-efforts basis through [email protected]. No uptime, response-time, or service-level commitment applies unless agreed in writing.
4. Acceptable use
You must not misuse the Services, interfere with their operation, probe or bypass security controls, reverse engineer them except where law expressly permits, access data without authorization, upload malware, submit unlawful content, or use the Services in violation of law, Shopify's terms, or third-party rights.
5. Warranty programs & your responsibilities
The app provides workflow tools; AmareTech is not the seller, manufacturer, warrantor, or claims decision-maker. Merchants are solely responsible for their warranty terms, eligibility rules, disclosures, customer communications, claim decisions, RMAs, replacements, refunds, repairs, and compliance with consumer-protection and privacy laws. You must configure forms to collect only information you are authorized to collect, publish all notices and warranty terms required by law, and keep those notices and terms accurate. The app does not automatically approve or deny claims.
6. Customer submissions & uploaded content
As between you and AmareTech, you retain ownership of registration records, claim submissions, receipts, images, documents, feedback, and other content submitted for your store ("Merchant Data"). You grant us a limited right to host, copy, transmit, and otherwise process Merchant Data only as needed to provide, secure, support, and improve the pilot. You must have all rights and notices needed to submit that data and must not solicit unlawful, malicious, or unnecessarily sensitive content. We may restrict files or remove content that threatens the security or lawful operation of the Services.
7. Privacy & data protection
Our Privacy Policy describes our data practices. For customer information collected through your forms, you generally act as the party determining the purpose and means of processing, and AmareTech processes the information to provide the app. You are responsible for responding to customer requests and we will provide reasonable assistance. You must promptly notify us of any suspected unauthorized access involving the Services.
8. Feedback
You may provide suggestions, bug reports, and other pilot feedback. You grant AmareTech a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without identifying you or disclosing your confidential information. Feedback is voluntary and does not transfer ownership of your Merchant Data.
9. Intellectual property
We retain all rights to the Services, including software, branding, and content, excluding your store data, which remains yours. We process your store data solely to provide the Services.
10. Pre-release disclaimer
The pilot Services are pre-release and provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, and error-free results. You should independently preserve records needed to administer warranties and should not rely on the pilot as your only recordkeeping system.
11. Limitation of liability
To the maximum extent permitted by law, AmareTech will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business opportunities, or data. Our total liability arising from the pilot will not exceed the greater of the amount you paid for the pilot in the three months before the event giving rise to liability or US$100. These limitations apply only to the extent permitted by law.
12. Suspension, withdrawal & termination
You may leave the pilot at any time by notifying us and uninstalling the app. We may suspend or end pilot access at any time, including for security, legal, operational, or product reasons, and will provide notice when reasonably practicable. After termination, you should export any records you need; data is then handled under our Privacy Policy and applicable Shopify erasure requirements. Sections that by their nature should survive—including ownership, feedback, disclaimers, liability limits, and accrued obligations—will survive termination.
13. Changes to the pilot or these Terms
We may update the pilot and these Terms as testing progresses. We will provide reasonable notice of material changes. Continuing to use the pilot after the effective date of updated Terms constitutes acceptance; if you do not agree, you must stop using the Services.
14. General
These Terms and any written pilot invitation form the agreement between you and AmareTech regarding the pilot. If they conflict, the signed written agreement controls. You may not assign the agreement without our consent. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. Applicable law governs these Terms without overriding any mandatory rights that cannot lawfully be excluded.
